The article explores the legal nature, structure, and functional dimensions of the institution of ad- ministrative control over the activities of business entities engaged in foreign economic activity (FEA). The relevance of the topic arises both from the general process of transformation in public governance and the specific legal conditions imposed by the martial law regime in Ukraine, under which administra- tive control in the FEA sphere performs not only a legal-regulatory but also a strategic security function. Particular attention is devoted to the regulatory framework of administrative control, including anal- ysis of the provisions of the Commercial Code of Ukraine, the Customs Code of Ukraine, the Laws of Ukraine “On Foreign Economic Activity,” “On Currency and Currency Operations,” and “On the Basic Principles of State Supervision (Control) in the Field of Economic Activity.” Within the scope of the study, the main legal forms of control implementation are identified, including licensing, customs con- trol, currency control, inspections, and administrative procedures, which may have preventive, puni-tive, or regulatory nature. It is emphasized that administrative control in the field of FEA serves as a mechanism for safeguard- ing the public interest within an open economy. It ensures a balance between entrepreneurial freedom and state priorities in areas such as security, fiscal stability, currency regulation, and customs compli- ance. The article presents the author’s perspective on the necessity of transitioning toward a partner- ship-based model of control, founded on principles of legal certainty, digitalization of procedures, min- imization of duplication of authority, and delineation of control competences among executive bodies. The article summarizes the current challenges in the implementation of administrative control: excessive interference, overlapping inspections, low inter-agency coordination, and underdeveloped electronic procedures. The study substantiates the expediency of further codification of administrative legal instruments of control, which would contribute to strengthening Ukraine’s economic security amid external threats.
