Abstract Environmental Impact Assessments or commonly known as EIA, are a crucial steps to conduct for ensuring that the risk and harm from a projects or activities won’t resulted in irreversible damage to the environment. In recent development, the role of EIA has been expanded to also include maritime environment including the area beyond national jurisdiction. The importance of EIA in such projects and activities has been enshrined in a newly adopted agreement under the United Nations Convention on the Law of the Sea on Marine Biodiversity Beyond National Jurisdiction (BBNJ Treaty). This research analyzes various international legal frameworks, and relevant jurisprudence, to establish EIAs as an essential tool for mitigating environmental risks. Additionally, this paper will delve further on the role and impact the Implementation and Compliance Committee could serve as established body under the agreement to serve a facilitative assistance in ensuring State Member compliance.
