The article is devoted to the analysis of the peculiarities of the introduction of electronic record keeping in the legal practice of Ukraine in the context of digital transformation of society. Its essence is the use of modern information and communication technologies for the creation, storage, exchange and protection of legally significant documents, which helps to increase the efficiency of law enforcement. Much attention is paid to the analysis of the regulatory framework governing the functioning of electronic document circulation, which regulate electronic submission. It is noted that despite the regulatory consolidation, the effective work of the ESIT is complicated by technical interruptions, lack of technical support and restriction on access to the participants of the trial. A number of organizational and technical problems are analyzed, in particular: insufficient unification of the regulatory framework, low level of digital competence of employees of legal institutions, the need to ensure compatibility of digital platforms between different state structures and legal entities. The need for comprehensive staff training, in particular in the field of electronic signature, data safety and digital communication, is noted. In the procedural aspect, the emphasis is on the difficulties related to determining the status of electronic evidence, confirming the legitimacy of electronic signature, verification of the parties during the remote submission of procedural documents and the lack of mechanisms of response to technical failures. The author emphasizes the need to further improve procedural legislation in order to properly regulate the procedures for submission, recognition and verification of electronic evidence, as well as ensuring the continuity of access to the electronic platform of the judiciary. As a result, complex measures for optimization of electronic record keeping were proposed: harmonization of legislation in the field of digital evidence and electronic signature, development of technical infrastructure, unification of digital solutions, introduction of mechanisms of automatic identification in the ESITS, as well as enhancing digital culture among legal education.
