This research aims to study legal insanity in criminal law in Germany. The doctrinal legal analysis research method is employed to examine the concept of legal insanity in Germany. The concept of criminal responsibility is central to criminal law in Germany. An offender with severe mental health issues cannot be declared guilty for his crimes. The law in Germany does not consider such an offender guilty subject to the fulfillment of specific criteria. Section 20 of the Criminal Code of Germany 2009 deals with the offenders with mental health issues. Mental health evaluation of mentally abnormal offenders is mandatory to determine culpability. Capacity building of relevant stakeholders and the amendment of law in the light of modern advancements in the field of mental health sciences are recommended to better meet the objectives of the law on mentally abnormal offenders in Germany.
