The judicial review is considered to be the supremacy of law in India. The courts are obliged to look after the legislative. Executive and judiciary respectively. The judicial review such power where courts can make law and order unconstitutional if there is conflict between the basic law of the land. Judicial review refers to how judiciary interprets the laws in the constitution and also can implement the law and orders of the legislature or executive. The main goal of judicial review is to maintain the integrity and uphold the supremacy of constitution, protects one’s fundamental rights, and ensures that all the three branches of government deal in the ambit or areas only constitutionally. Judicial review also fixes the contradiction or errors helps in promoting justice as well. This paper basically will focus on how the concept was originated from the landmark judgements that is Marbury V. Madison. A brief history of judicial review is been mentioned where it tells how it rooted in England and then how it came in United States focusing on the influence judicial review made globally across UK, USA and India specifically. Through this paper the author has made an attempt to present how judicial review is in UK, USA, INDIA with landmark precedents and the present scenario of it today’s time.
