This article is devoted to the analysis and characterization of the role of the state in the legal regulation of educational migration. Russian migration legislation expresses the need to attract educational immigrants, but there is no use of the term “educational migration” and similar expressions in key acts. The description of the desired phenomena in the field of actual educational immigration is carried out without the use of specific terms. Based on the results of the study, this point can be considered a disadvantage of the current legislation. The introduction of the term “educational immigration” and related expressions may be useful for more accurately defining phenomena in the field of educational immigration.
