However, despite the great benefits of AI, it may also pose serious risks to society. In the medical sector, we have noticed tremendous developments thanks to the use of artificial intelligence applications such as smart robots in surgeries and health care, and programs to support medical decisions and assist in diagnosing and suggesting treatments, which provide doctors with information that they did not have access to before.Despite the many advantages of this technology, special challenges arise related to how the current legal system - especially with regard to civil liability laws - deals with the unique characteristics of this technology. Artificial intelligence in the medical field is not free from errors, and may cause damages that must be addressed and those affected must be compensated. .This study aims to answer an important question: How will the development of medical artificial intelligence change the legal logic of civil liability law? We will discuss whether current laws are sufficient to adapt to new risks and compensate for damages resulting from the use of artificial intelligence in the health sector, or does it require setting new rules and establishing a special liability system for these modern smart systems?
