The rise in the digital economy in India has led to changes in the structure of employment, resulting in gig economy through platforms like food delivery and ride-hailing companies, among others. This paper seeks to investigate the changing status of gig workers in India regarding their status as independent contractors. It involves the analysis of existing labor laws, including the Code on Social Security, 2020, and its ability to protect the rights of the gig workers regarding issues such as wage protection, social security, and conditions of employment. There will also be a review of judicial and international trends in gig worker regulation to identify ways to balance flexibility with necessary regulations. Through addressing the shortcomings of the existing legal provisions, this paper will argue the need for statutory recognition of the gig workers’ status as independent contractors to ensure they get their rights.
