The study discusses the role of constitutions in ensuring transitional justice after conflicts. The study is divided into two sections: the first is devoted to the conceptual and legal framework of transitional justice and the transitional constitution, while the second is devoted to applied case studies of transitional justice in Iraq and South Africa, based on analytical and historical approaches. The research problem was to demonstrate the extent to which constitutions can build new political systems within the context of transitional justice. We concluded the research with a number of findings and proposals. The main result was that the link between transitional justice, the transitional constitution, and the new political system is a necessary and reciprocal relationship that complements the political (transitional justice), legal (transitional constitution), and institutional (new political system) context. The research was divided into an introduction, two chapters, a number of demands, and a conclusion that included the results reached and the proposals in light of them. The first chapter was devoted to the conceptual and legal framework of transitional justice and the transitional constitution, while the second was devoted to studies of applied cases of transitional justice in Iraq and South Africa.
