Integration Principle between the International Criminal Court and Israeli National Courts in the Context of the Palestinian Situation

Objective: This study offers a critical legal analysis of the jurisdictional obstacles affecting the International Criminal Court’s (ICC) exercise of jurisdiction over the Situation in Palestine. It focuses on the application of the principle of complementarity under Article 17 of the Rome Statute, assessing whether Israeli domestic judicial mechanisms meet the legal thresholds required to challenge the admissibility of cases before the ICC. Methodology: The study adopts a critical analytical legal methodology, examining the normative framework governing complementarity alongside an evaluative assessment of Israeli legislative provisions and judicial practices. This approach measures compliance with the international standards of “willingness” and “ability” to prosecute core international crimes. Main Results: The analysis identifies a structural legislative deficiency within Israeli domestic law, notably the absence of explicit criminalization of war crimes and crimes against humanity, which undermines the criterion of “ability.” Additionally, the study finds that internal investigative mechanisms frequently fail to satisfy the requirement of genuineness, as serious violations are often addressed through administrative or disciplinary processes rather than criminal accountability. These patterns raise substantial concerns regarding institutional unwillingness. Conclusions: The study concludes that the invocation of complementarity by Israel functions primarily as a procedural challenge to admissibility rather than as evidence of genuine domestic accountability. Domestic proceedings are assessed as insufficient to meet international standards required under customary international law. Recommendations: The study recommends that Palestinian legal efforts prioritize the systematic documentation of deficiencies in domestic investigations to support admissibility determinations by the Office of the Prosecutor. It further advocates enhanced reliance on international cooperation mechanisms and strategic engagement within the Assembly of States Parties to advance accountability processes. الهدف: تهدف هذه الدراسة إلى إجراء تحليل قانوني نقدي لإشكاليات إعمال الولاية القضائية للمحكمة الجنائية الدولية في "الحالة في فلسطين"، مع التركيز على تفكيك الدفوع المتعلقة بـ "مبدأ التكامل" المنصوص عليه في المادة (17) من نظام روما الأساسي، وبيان مدى صلاحية القضاء الوطني الإسرائيلي لحجب اختصاص المحكمة الدولية. المنهج: اعتمدت الدراسة المنهج القانوني التحليلي لتفكيك النصوص الناظمة لمبدأ التكامل، بالتوازي مع المنهج النقدي التطبيقي لفحص مدى مواءمة التشريعات والإجراءات القضائية الإسرائيلية مع المعايير الدولية الخاصة بـ "الرغبة" و"القدرة". أهم النتائج: خلص البحث إلى أن النظام القضائي الإسرائيلي يعاني من "عجز تشريعي بنيوي" يتمثل في غياب التكييف القانوني للجرائم الدولية (جرائم الحرب والجرائم ضد الإنسانية) ضمن القانون الجنائي المحلي، مما ينفي ركن "القدرة". كما أثبتت الدراسة أن التحقيقات الداخلية الإسرائيلية تفتقر إلى معيار "الجدية"، وتُكيّف وقائع القتل والانتهاكات الجسيمة كأخطاء إجرائية أو قضايا فساد إداري، مما يؤسس لحالة من "عدم الرغبة" الممنهجة، ويجعل من مبدأ التكامل أداةً للإفلات من العقاب بدلاً من تحقيق العدالة. الاستنتاجات: يستنتج البحث أن التمسك الإسرائيلي بمبدأ التكامل هو دفع "كيدي" يهدف لتعطيل مقبولية الدعوى، وأن القضاء الإسرائيلي يمارس دور "الدرع القانوني" عبر إجراءات صورية تهدف حصراً لنزع الاختصاص عن المحكمة الدولية دون تحقيق مساءلة جنائية حقيقية تتفق وقواعد القانون الدولي العرفي. التوصيات: يوصي البحث بضرورة تبني استراتيجية قانونية فلسطينية تركز على تقديم أدلة قطعية للمدعي العام تثبت "صورية التحقيقات" الإسرائيلية لتعزيز قرار "المقبولية". كما توصي بتفعيل آليات التعاون الدولي عبر "الإنتربول" لإنفاذ مذكرات التوقيف، واستثمار المركز القانوني لفلسطين في جمعية الدول الأطراف للدفع باتجاه تفعيل الولاية الجبرية للمحكمة على الجرائم المستحدثة.
