Abstract The Controller General of Patents, Designs and Trade Marks’ recent acceptance of a trade mark consisting of the ‘floral fragrance/smell reminiscent of roses as applied to tyres’ filed by Sumitomo Rubber Industries Ltd. (Application No. 5860303) marks India’s first attempt to register a scent trade mark and highlights the unresolved conceptual and procedural discrepancies surrounding olfactory marks in India.
