One of the recent trends in penal policies is the system of releasing a person sentenced to a custodial sentence due to his health conditions. Under it, the convict is allowed to leave the penal institution if his condition requires special care or treatment that is not available within the penal institution. His health condition may be chronic, whether organic or not. Membership of serious psychological disorders or other disorders that may be a reason to consider health release, especially if these cases require care for long periods, especially if the correctional institution’s capabilities are limited in providing the required health care, to be a more compelling reason to consider health release, which requires a comprehensive evaluation. For the case of the convict, a number of legal procedures are followed in accordance with specific standards, which requires a correct legal adaptation that explains the nature of the procedure and the reason for its existence.
