It is well established that in criminal law, the subjective element of an offence –encompassing the forms of culpability, intent, purpose, and motive – is of decisive importance in the accurate legal classification of any crime. This paper investigates the role and significance of subjective indicators in classifying offences related to the violation of wildlife and flora use regulations and the cruel treatment of animals.
