The presented publication raises the problem of the social conditionality of the criminal law protection of the digital security of the healthcare system and its theoretical and applied understanding. As a result of the conducted research of the available doctrinal points of view and on the basis of its own formed concept of digital security of the healthcare system, it is stated that the social conditionality of criminal law protection of the digital security of the healthcare system is determined by a complex of interrelated factors: historical, economic, socio-legal, political, international, psychological and others. It is noted that any criminal law prohibition should not be imposed by the State arbitrarily, without taking into account factors indicating its objective social necessity. A definition of the concept of social conditionality of criminal law protection of the digital security of the healthcare system as a complex category is being formed, which, as a whole, seems to expand and complement criminal law science.
