The article analyzes the procedural rules governing the procedure for initiating a case by drawing up a protocol on an administrative offense by an official. The Supreme Court of the Russian Federation is gradually filling in the gaps identified in the normative regulation. The article accumulates the legal positions of the Supreme Court of the Russian Federation regarding the procedure for drafting the most important procedural document — the protocol on an administrative offense, in order to draw the attention of officials performing law enforcement functions to the need to comply with all procedural rules in order to ensure the principle of legality.
