This study reviews rights to public health of senior citizens inconstitutional view. Health problem of the aged is a big social conundrum, bothindividual and country. Constitutional Para 3 of Article 36 stipulate “the health of allcitizens shall be protected by the State.” It is rights to public health as one ofConstitutional rights, especially Social Constitutional Rights. I review Medibank ofNational Health Insurance Act, medical benefits of Medical Care Assistance Act,health support of senior citizens of Welfare of the Aged Act and Management ofdementia Act, and Long-term-care insurance of Act on Long-Term Care Insurance for the Aged et cetera, according to the standards of the constitutional. If thelegislator does not take minimal action of Constitution, Constitutional Court declaresa violation of the Constitution.
