Mothers Behind Bars: The Rights of the Child and the Gendered Impact of Incarceration in India

The incarceration of women, particularly mothers, in India represents a critical yet often overlooked human rights issue with profound intergenerational consequences. This paper examines the unique plight of children of incarcerated mothers, arguing that the Indian criminal justice system, in its current form, systematically violates the fundamental rights of the child as enshrined in both international law and the Indian Constitution. The research employs a qualitative, doctrinal analysis of legal frameworks, prison statutes, and judicial precedents to highlight the gendered nature of incarceration. It posits that women offenders are frequently primary caregivers, and their imprisonment creates "collateral convicts"-innocent children who suffer the loss of family care, stigma, and severe developmental setbacks. The analysis reveals significant gaps in Indian prison policies, including the inadequate implementation of the Model Prison Manual 2016, the arbitrary upper age limit (six years) for children to reside in prison with their mothers, and the lack of viable, state-supported alternative care mechanisms. The paper concludes that a rights-based, child-centric, and gender-sensitive approach is urgently needed. Recommendations include legislative and policy reforms to promote non-custodial sentencing for primary caregivers, the creation of mother-and-child-focused prison facilities, and robust post-release support systems to safeguard the best interests of the child and mitigate the gendered collateral damage of incarceration.
