Key Points

  • The TEF Rules improve the arbitration process for high-net-worth families, ensuring efficiency and confidentiality.
  • Provisions include model arbitration clauses, streamlined tribunal appointments, and applicable law in estate matters.
  • These new Rules are predicted to significantly increase arbitration's role in private-wealth disputes.
  • Switzerland is positioning itself as a leading jurisdiction for resolving trust and estate conflicts through these reforms.

Abstract

Abstract With the introduction of the Trust, Estate, and Foundation (TEF) Rules, in force from 1 July 2025, Switzerland is further strengthening its position as a prime jurisdiction for the arbitration of trust, estate, and foundation disputes. The new Rules provide a modern, efficient, and confidential process tailored to the needs of high-net-worth (HNW) families as well as trust and foundation practitioners. The TEF Rules are expected to increase the use of arbitration in private-wealth matters. In addition to the model arbitration clauses, the TEF Rules contain provisions on their scope of application; information, notification, and representation of entitled persons; appointment of the arbitral tribunal; and applicable law in estate matters.
