Abstract

The article is devoted to the problems of making deals, the subject of which is such a type of property complex as a single real property complex. It is concluded that there is a gap in the legislative regulation of such deals: there are no legal norms regulating the specifics of concluding certain types of contracts, the subject of which is a single real property complex, such as a sale agreement, a lease agreement. In relation to another type of property complex – an enterprise – similar legal norms are enshrined in the Civil Code of the Russian Federation. It is proposed to make appropriate changes to the Civil Code concerning a single real property complex, by analogy with an enterprise. In addition, the problems and risks arising in the context of remote (electronic) transactions, namely, sales and lease agreements concluded in relation to single real property complexes, are analyzed.
