Normative translations of civil servants: novelties of the current legislation

In April 2024, Federal Law No. 87-FZ "On Amendments to the Federal Law" On the State Civil Service of the Russian Federation "was adopted." Central among the changes that have been made to the legislation on the state civil service are the norms on the transfer of civil servants to another position. The Law on the State Civil Service, adopted in 2004, actually preserved for state civil servants those models of legal regulation of labor that were enshrined in labor legislation. In particular, this also applies to transfers, which in labor relations are predominantly dispositive in nature and are carried out by agreement of the parties to the relevant relations. Meanwhile, in the public service, the need for such a transfer is often not related to the discretion of the parties to the service contract, but is dictated by the interests of the service (for example, transfers for the purpose of rotation). Accordingly, this implies other regulatory regulation of such transfers.
