Abstract

Abstract Classical jurisprudence and the theory of state and law face permanent normative latency. This originates from incompatible temporal scales: classical law relies on protracted deliberative procedures, while computer algorithms operate in milliseconds. Drawing on Paul Virilio's dromology and Antoinette Rouvroy and Thomas Berns' theory of algorithmic governmentality, this study dissects digital power mechanics. It uses speed as its methodological framework. The article introduces the socio-technical paradigm of Infrastructural Update Authority. Its defining characteristic is dromological. The dictate of millisecond-speed code deployment is the supreme form of categorical legislative action in the digital epoch. The paper argues that a global infrastructural patch (software update) instantly and unilaterally rewrites the material constitution of the world, bypassing political, democratic, or judicial consensus. The study analyzes the July 2024 global CrowdStrike IT incident to validate this proposition. This event instantly paralyzed critical infrastructure worldwide, disrupting aviation, healthcare, and finance. The precedent demonstrates that de facto legislative initiative and rule-making capacity have shifted from national parliaments to the technical divisions of transnational corporations during design-time and deployment. Consequently, traditional parliamentary sovereignty becomes subordinate to algorithmic dictate. To address this asymmetry, the research proposes institutionalizing the Contestability by Design principle. This approach mandates integrating democratic oversight mechanisms directly into the algorithmic update release pipeline. Note: Version 2 features an explicit methodological framework (exploratory single-case study), a sharper articulation of the research gap regarding deployment logistics, and expanded theoretical counterarguments addressing industry pushback (the Zero-Day Paradox). Structural flow has been optimized, including a newly dedicated section on the structural shift in legislative action. Core findings regarding Infrastructural Update Authority remain unchanged.
