Abstract

Newly signed legislation in California will give judges more discretion in determining client eligibility for the state's Mental Health Diversion Program. Prosecutors and other stakeholders in the state had argued that public safety concerns were not being sufficiently addressed in the program, which offers some criminal defendants with mental illness an alternative to prosecution and incarceration.
