The thesis is devoted to a very topical topic of the process of recodification of the current economic legislation of Ukraine, studying certain aspects of legal nature, motives and consequences. This debate has been going on for over fifteen years, since the adoption of two powerful legal acts - the Civil Code of Ukraine and the Commercial Code of Ukraine - simultaneously resulted in most of the provisions having overlapping content, although legal practice has been able to adapt to this phenomenon and show some positive results of such interaction. Various academic circles, including well-known lawyers, jurists, civilists and businessmen, have devoted extensive discussions to this problem at roundtables, conferences and forums, in search of optimal mechanisms for improving such relations, but unfortunately, no consensus has been found. We are of the opinion that it is advisable to comprehensively modernize economic legislation on the basis of the existing Economic Code of Ukraine, and we propose to revise outdated provisions and replace them with modern relations, to revise existing regulations which are closely related to and interact with economic legislation, to update them and to improve the ways of certain interaction.
