The purpose of the work is to analyze the existing problems in the field of management of multi-apartment residential buildings in the territories of municipalities, including the reasons why such houses remain without management by management organizations, homeowners' associations or housing cooperatives. The norms of housing legislation providing for the choice of a method of managing residential buildings are analyzed, including those establishing the duties of local governments to hold open tenders in cases where the above-mentioned method of management has not been chosen by the owners of residential premises, or has not been implemented by them. The conclusion is formulated about the need to create guaranteeing management organizations in an organizational and legal form — municipal unitary enterprises. It is proposed to amend the Housing Code of the Russian Federation in order to create such organizations, as well as to amend the Federal Law “On Protection of Competition”, which will give local governments the right to create guaranteeing management organizations.
