The Position of Bawaslu as a Third Party in Election Disputes

In Indonesia, Bawaslu has a crucial role as a third party in handling election disputes. Although Bawaslu has a strong mandate, handling election disputes is not easy. The challenges faced include legal complexity, political pressure, and the need for adequate resources. This study aims to examine the position of Bawaslu as a third party in resolving election disputes. A qualitative method is being used in the research. The study's findings are as follows: 1) Bawaslu's position as a third party includes maintaining the integrity and fairness of elections in Indonesia. Facing political pressure and difficulties in collecting sufficient evidence to make the right decisions. 2) Bawaslu's roles include several roles that include supervision, law enforcement, mediation, dispute resolution, facilitation of political dialogue, public education, and guarding the integrity of democracy. 3) The challenges faced by Bawaslu include legal and procedural complexity, limited resources, political pressure, inequality in access to information, and political disputes, all of which are obstacles in carrying out these tasks. In addition, technological and cybersecurity challenges also have a significant impact, given the increasing role of technology in the election process. In addition, enforcing decisions is also a challenge in itself, because decisions taken by Bawaslu may not always be followed or implemented by the losing party in the dispute
