In the presented article is made a short excursion into the historical development of the principle of proportionality, is studied the precedent chronicle of its inclusion in the practice of the European Court of Human Rights. The component elements of the principle of proportionality are analyzed in detail. The critical opinions available in the literature regarding this principle were studied, and an attempt was made to distinguish between their justified and unjustified aspects. The corresponding analysis was carried out with reference to specific court cases from the practice of the ECtHR.
