Once again about the Amount of Administrative Fines for Legal Entities (A Brief Comment on the Definition of the Constitutional Court of the Russian Federation dated November 14, 2023 No. 3017-O)

The article analyzes the legal positions expressed in the Ruling of the Constitutional Court of the Russian Federation No. 3017-O dated November 14, 2023 regarding the amounts and methods of calculating administrative fines imposed on legal entities. In general, the authors share the assessments of the Constitutional Court of the Russian Federation made by it following the results of studying the complaint against the administrative fine provided for in part 1 of Article 16.1 of the Administrative Code of the Russian Federation in respect of legal entities, since, in combination with other rules provided for by this Code, its application ensures compliance with the principles of proportionality and individualization of punishment for an administrative offense committed.
