Law and Intelligence: To Know the Commonality of Social and Psychological Functions (Theoretical Study)

Relevance. The phenomenon of law as a special civilized, intellectual and value-substantive social authority attracts the attention of scientists to conceptualize its current state, development trends and problems of formation. It is relevant to establish the functional role of certain social groups in the formation of law and the mechanisms (algorithms) for its effective, fair and correct application in social reality. Various social structures and groups are involved in the development, acceptance, adaptation to social reality and assessment of applicability in life. A special social subject in the triumph of law and justice, as well as the development of its norms, is the intelligentsia, which, being a specific domestic phenomenon, at different stages of the historical development of the state and society acted as a catalyst for both the abolition of outdated norms and the rapid development of law, taking into account the needs of broad social groups. Materials and methods. The purpose of the research in the article is a comprehensive knowledge of law and the intelligentsia in their functional relationship and relationships of codependency in the minds of the subjects. The subject of the study is to understand the commonality of the social functions of law and the intelligentsia, based on the role of the domestic intelligentsia in the formation of law. To solve research problems, the authors use systemic, activity-based and formal legal approaches as a methodology, which involve the use of component, structural, functional, historical and other types of analysis, synthesis of its results, analogy, comparison, generalization, deduction and abstraction. Results and conclusions. The main results of the study include: conceptualization of the commonality of social functions of law and the intelligentsia, as well as the conclusion that in the development of the “fabric of law” and “social life of law” an active functional role is played by the intelligentsia and intelligence, which is one of the characteristics of the identity of the domestic legal system.
