This joint comparative legal note, prepared within the ELSA Paris Nanterre x ELSA Belfast partnership, examines how fashion brand identity is protected through trade marks, design rights and enforcement mechanisms in France and the United Kingdom. It addresses the post-Brexit significance of first disclosure, territoriality, online targeting, post-sale recognition and the boundary between protectable brand identity and free style circulation. The note is intended as an early-career academic contribution and as the first step of a broader Fashion Law initiative between the two ELSA sections.
