Analysis of European integration impacts on border legislation in Ukraine, implying the need for improved security measures.
The sphere of border security in Ukraine is currently regulated by uncodified dispersed legislation: numerous different legislative and subordinate legal acts, interdepartmental and departmental instructions, etc. However, as of today, there is no single codified legal act that comprehensively regulates the state border policy; some provisions of the current legislation are outdated or duplicate each other; mechanisms for its implementation are not sufficiently coordinated between the authorities. In the context of Ukraine’s European integration, the analysis of the European Union’s progressive experience on the legal regulation of legal relations in the border sphere and in ensuring the human right to free movement as a basis for improving national legislation as a basis for improving of the national legislation is serving. The war with russia and the crisis of global security systems are required for including mechanisms for implementing national security within the legislation on the state border of Ukraine. The strategic objectives of maintaining security in the border sphere and European integration indicate the necessity to improve legislation by formulating a Conception of the Development of Legislation of the State Border of Ukraine in the Context of European Integration. In the sphere on border security, this will mean: ensuring national interests in the border area at the level of EU standards; integration into the system of joint European border management (Integrated Border Management, IBM); unification of border control procedures; ensuring effective cooperation with FRONTEX and law enforcement agencies of the neighboring countries, etc. The Conception will allow to develop and adopt: “Code of Ukraine on Border Issues of Ukraine” (Border Code of Ukraine) or “Code of Ukraine on the State Border and Border Activities”, which will: systematize the current legislation; allow to define the basic principles of state policy in the sphere of border security; will bring it in line with EU standards; and will become a strategic basis for regulatory and for legal regulation in the sphere of border security.
