ABSTRACT Premeditated murder poses significant challenges in terms of its understanding and the application of its rulings between Islamic Sharia and Afghan criminal law, highlighting the need for a comparative study of the concept of the crime, its elements, types, and punishments. This study aims to analyse this crime from the perspective of Islamic Sharia and Afghan law, highlighting the masjid (higher objectives) behind criminal legislation in Islam, identifying the challenges facing the implementation of capital punishment and retribution under modern legislation and external influences, and examining the differences between Sharia rulings and legal texts in determining the crime’s elements and the conditions for enforcing punishment. The study adopts both analytical and inductive methodologies by surveying Sharia evidences and the opinions of classical and contemporary jurists, followed by analysing and comparing them with Afghan legal texts. The study concludes that the prohibition of premeditated murder is firmly established through the Qur’an, Sunnah, and scholarly consensus, and that legislation derived from Sharia affirms the importance of deterrent punishments. The findings also indicate that the implementation of Sharia punishments faces challenges due to contemporary legal and political influences. The study recommends the need to strengthen coordination between Islamic jurisprudence and criminal law, and to remove obstacles that hinder the enforcement of rulings in accordance with Sharia principles, while taking into account the social and legal dimensions to ensure justice and societal security.
