Theoretical framework: The notion of State and sovereignty has a deep meaning in the context of the use and exploitation of resources, as well as in the guarantee of well-being for the population within its territory. This concept, originated in the modern era, is related to various socio-cultural, economic and political events. It is made up of elements such as territory (resource), people (population), power (government) and sovereignty (rights), the latter understood as the authority that the people transfer to a government. Method: Mixed, descriptive and non-experimental method, based on bibliographic analysis and statistical interpretation provided by state institutions, using the SPSS package Results and Discussion: The results show that the Peruvian State is the entity responsible for regulating and controlling the territory and society; Mining concessions in Peru, being areas granted for the exploration and exploitation of mineral resources and being subject to collective rights, have generated controversies due to their environmental impacts, the quality of life and the participation rights of the social actors involved in these territories. Research Implications:The internal recognition of a delimited territory and the external distinction of other states is not exclusive to the nation-state, but also an expression of the legal-political order of the peoples that make up the State, thus maintaining a duality in the definition of power. at the local (traditional) level.
