This article is aimed at studying the legal status of the family institution within the framework of the welfare state, paying special attention to the intersection of family law, the values of society and the protection of individual rights within the family. The study examines the principles, rules and problems associated with the legal status of the family institution, taking into account the influence of cultural, historical and social factors on the development and implementation of family law. The legal status of the family institution in the context of digitalization and the use of AI technologies in a social state reflects the general principles of ensuring equality, dignity and interests of family members, especially children.
