The article considers the consequences of differentiation of insolvency proceedings into main and secondary ones for determining the characteristic of the competence of Russian courts to resolve cases of subsidiary liability. It is shown that the Russian court can resolve such disputes both in the bankruptcy case and outside the bankruptcy case, even if only a secondary insolvency proceeding can be introduced against a foreign debtor in Russia.
