The present work aims to analyze the constitutional and federal legal models of civil defense adopted in Brazilian Law, taking civil defense as a premise as a manifestation of the State's administrative activity. The legal concept of civil defense is exposed, the way in which the competencies that are pertinent to them are outlined in the current legal system, and the rights of those administered regarding control of the administration and the civil liability of the State. To this end, the methodology recommended by Legal Dogmatics (or Science of Law in the strict sense) is used, which chooses as its object the system of Positive Law that is in force.
