Introduction: the article presents an analysis of penitentiary crime as one of the most dangerous forms of penitentiary deviance, considering its essential characteristics. A particular focus is placed on the distinctions between penitentiary crime, dependent on the characteristics of the perpetrators. Materials and Methods: the authors employed the dialectical method, a range of scientific methods, including general and specific scientific methods, systemic and structural-functional approaches. Results of the study indicate that the differentiation of penitentiary crime depending on the carriers is of particular practical importance in the prevention and minimisation of it. Discussion and Conclusions: penitentiary crime, as a phenomenon that challenges the efficacy of institutions designed to execute punishment, demands rigorous examination of its essence and distinctive characteristics among its carriers. This is essential for the development of effective prevention strategies.
