The subject of the study is the problems of legal regulation of the contract of participation in shared construction. The purpose of this work is to identify the shortcomings of the equity agreement in relation to individual residential buildings, by comparing it with the agreement of participation in the shared construction of apartment buildings. The objectives of the study are: 1) comparing two types of equity agreements; 2) studying their similarities and differences; 3) identifying problems and finding ways to solve them. As a result of the work carried out, the concept of an equity participation agreement, its parties and the main conditions were studied. It has been established that the object of individual housing construction is an individual residential building with an adjacent land plot. It was also revealed that the developer is building, first of all, a low-rise residential complex, within which the construction of individual residential buildings is carried out. The recommendations given in the article will contribute to improving the legal regulation of contractual relations in the field of shared construction.
