The purpose of the article is to study the reasons for the reduction in the number of people in custody over the past 20 years. The research method is the analysis of statistical data reflecting the practice of choosing this preventive measure and a number of Federal laws that changed or supplemented the norms of substantive and procedural criminal law during this period. The result of the study: a significant decrease in the use of this preventive measure was mainly a consequence not of the judicial procedure for making a decision on it, but of a decrease in the number of persons brought to criminal liability and the effect of Federal laws limiting the possibility of its application.
