The author analyzes the provisions of family legislation from the perspective of spouses exercising freedom of reproductive choice, focusing on the socio-legal existence of marriage, the gender of the spouse as a factor in deciding whether the family performs the reproductive function. In addition, the author evaluates the initiative of the constituent entities of the Russian Federation in the area of establishing responsibility for inducing a woman to undergo an artificial termination of pregnancy.
