The article studies the ruling of the Judicial Chamber on Criminal Cases of the Supreme Court of the Russian Federation (the legal position) that has the significance of a precedent, and states that: the basic reason for the illegal conviction of a common-law partner for “stealing” a part of jointly acquired property lies in formal gaps in family and civil law branches.
