Abstract

The purpose of this study is to identify legal protection efforts guaranteed by positive law in Indonesia for children resulting from incest and explore the obstacles in their implementation. The method used is library research with a normative approach, analyzing existing regulations as well as several incest cases in Indonesia. The findings show that incest victims are often unaware that they are experiencing violence, which makes them keep this secret out of fear and shame, as well as a lack of understanding that they are victims. Pressure and intimidation by perpetrators make victims feel helpless and accept violence as part of everyday life, and therefore do not report it. This leads to children of incest often not receiving the legal protection they deserve. To date, there is no specific regulation for children of incest. Important steps to be taken include addressing social stigma, increasing awareness of reporting, community support, strengthening law enforcement, and providing adequate resources. Collaboration between stakeholders, comprehensive sexual education strategies, and increased public awareness are essential to create a safe environment and support the rights of children of incest in Indonesia without discrimination.
