The European Union (EU) and its member states have a moral and legal obligation to act in the face of serious human rights violations (war crimes, crimes against humanity and possibly genocide) by the State of Israel in the Gaza Strip. The failure to act by the Council of the EU affects the bloc’s legal order and its basic principles, including the primacy of fundamental rights, as laid down in the articles of the EU-Israel Association Agreement and in the European treaties. Any member state could bring the action for failure to act provided for in Article 265 TFEU.
