Abstract

Abstract Der Aufsatz verortet Karl Kraus’ Essay in seinen zeitgenössischen Kontexten. Als Zeitschriftentext zu einem grotesk ungerechten Ehebruchsprozess läuft er Gefahr, selbst zum ,,Prangerverfahren“ zu werden, das in der sensationsheischenden Reinszenierung der Wiener Presse ohnehin schon eine ,literarische‘ Gestalt angenommen hatte. Demgegenüber schafft Kraus’ einleitende Montage von Shakespeare-Zitaten Distanz: An die Stelle einer Literarisierung des Rechts tritt die Verrechtlichung der Literatur. The paper situates Karl Kraus’s essay in its historical contexts. As a piece for his small magazine, written after a grotesquely unfair adultery trial, Kraus risked partaking in the public spectacle that the Viennese press made of it, especially insofar as it had already been transformed into a form of ,literary‘ entertainment by then. Against this, Kraus’s introductory montage of Shakespeare quotations establishes a distance: instead of literarizing law, what emerges is the juridification of literature.
