English Version Title: The Collapse of the Burkinabè State: Constitutional Vacuum and Crisis of Sovereignty Abstract This article examines the constitutional and sovereignty crisis in Burkina Faso as of October 2021, through the lens of comparative constitutional law. The author demonstrates that the Burkinabè State no longer satisfies the three classical constituent elements of statehood — sovereign territory, population, and effective political authority — as defined by general state theory. Drawing on Articles 31 and 32 of the Burkinabè Constitution, as well as Georg Jellinek's concept of Kompetenz-Kompetenz, he establishes that the progressive loss of territorial sovereignty to non-state armed groups constitutes a direct violation of the Republic's unitary and indivisible character. The article raises the central question of the legitimacy of a democratically elected but constitutionally failing power, and concludes that procedural democracy cannot prevail over national survival. The author calls for criminal accountability of those responsible for breach of oath, constitutional violations, and endangerment of the nation.
