Peculiarities of forensic examination of substantial harm presuppose taking into consideration a variety of factual circumstances of the occurrence of an event of fishing and substantiation of significant harm signs. Environmental engineering analysis is based on the study of how the event of violation of environmental legislation requirements affected the environment. on significance of environmental damage resulting from illegal fishing in the fishery is assigned when law enforcement agencies investigate violations of environmental legislation in court cases on claims of the State environmental inspectorate of Ukraine, the State Agency of Fisheries of Ukraine, local self-government bodies or other persons for damages caused as a result of unlawful withholding of fish resources from their natural habitat. essence of forensic examination is based on three joint signs that are inherent in the nature of a forensic expert’s special knowledge: subject, object and appointment of forensic examination. subject of the study on substantial harm resulting from illegal fishing is factual data on circumstances of fishing, the number of fish seized, total weight, size of a fish, species composition with reference to the territory of the water body, time period of fishing, and characteristics of water bodies, fish resources delineation in the corresponding category, in turn, are established on the basis of a forensic expert’s special knowledge, by conducting research on facilities provided by the body that appointed forensic examination. main objective of research while determining definition for substantial harm as a result of illegal fishing is confirmation of the fact of causing significant harm as a result of withholding fish resources from the natural habitat established by the State environmental inspectorate of Ukraine or the State Agency of Fisheries and recorded in the audit documentation, determining of the extent and characteristics of caused substantial harm by these bodies. object while study on substantial harm resulting from illegal fishing is documentary information in which factual data on a case are recorded.
