Documentary assessment reveals insufficient transparency in bailiff fee calculations in Latvian enforcement proceedings, indicating barriers to effective judicial review.
Verifiability of Enforcement Costs is an independent legal and documentary assessment of the transparency, legal certainty and effective review of enforcement-cost calculations in Latvian enforcement proceedings. The study examines documented enforcement case No. 01894/047/2026, with particular attention to the relationship between EUR 31.07 in enforcement costs recorded as actually covered and the subsequently stated EUR 807.47 payable amount, including EUR 580.62 described as percentage-based bailiff remuneration calculated on the amount recovered. The central legal question is whether the calculation base, applicable rate, relevant payments and mathematical methodology can be reconstructed from the information disclosed to the party. The analysis considers the requirements of verifiability, individualized reasoning, access to procedural information, legal certainty and the practical effectiveness of judicial review under Section 632 of the Latvian Civil Procedure Law. The publication also examines whether access to the information necessary to verify a financial claim can effectively be conditioned on payment for an informative statement or copies of the enforcement file. The analytical section is accompanied by primary documents in their original Latvian form, preserving the documentary record for independent professional, academic and potential judicial examination.
