AbstractCorporate fraud continues to pose a serious threat to financial stability, investor confidence,and ethical governance in both developed and developing economies.Whistleblowersindividuals who disclose information about unlawful or unethical conductwithin organizationsplay a crucial role in exposing corporate misconduct that may otherwiseremain concealed. However, the effectiveness of whistleblower protection mechanisms largelydepends on the legal frameworks that safeguard individuals from retaliation, victimization, orprofessional harm. This research examines the effectiveness of whistleblower protectionmechanisms in preventing corporate fraud through a comparative legal analysis of selectedjurisdictions. It evaluates the legislative frameworks, enforcement mechanisms, andinstitutional safeguards established to encourage reporting of wrongdoing within corporateentities. The study particularly analyzes the scope and limitations of legal protectionsprovided under whistleblower laws in jurisdictions such as the United States, the UnitedKingdom, and India. While countries like the United States have adopted robust statutoryframeworkssuch as the Dodd–Frank Act that provides financial incentives and antiretaliation protectionsother jurisdictions continue to struggle with weak enforcement andlimited protection for whistleblowers. In India, despite the enactment of the Whistle BlowersProtection Act, implementation challenges and procedural constraints undermine itspractical effectiveness in addressing corporate fraud. The research further examines the roleof corporate governance norms, regulatory bodies, and internal compliance mechanisms instrengthening whistleblower systems. By comparing international best practices with theexisting legal framework, the study highlights gaps in protection and proposes reforms aimedat improving transparency, accountability, and fraud prevention in corporate governance.Ultimately, strengthening whistleblower protection mechanisms is essential for fosteringethical corporate culture and ensuring effective detection and prevention of corporate fraud.
