In ages, commercial transactions were predominantly based on outright sales, requiring full payment before ownership and possession could pass. However, as commerce expanded and consumer demand increased, this rigid model proved inadequate for a growing population with limited purchasing power and made financial burdens becoming indispensable. The evolution of hire purchase reflects the transformation of commerce from rigid cash-based transactions to flexible credit-driven systems designed to accommodate economic realities, particularly in developing economies like Nigeria, where access to credit remains relatively limited and unevenly distributed. It emerged as a response to limited consumer purchasing power and has since developed into a widely accepted commercial tool used in financing and allows possession of goods upon initial payment, while ownership is deferred until the completion of instalments. It underscores the relevance in modern business practice, where access to assets without immediate capital outlay is essential for both individual advancement and business expansion. Hire purchase also serves as a bridge between the desire to acquire goods and the ability to pay for them outrightly. This paper critically evaluates hire purchase as a mechanism for facilitating commercial transactions and as a modern means of conducting purchasing business in Nigeria. It examines the legal foundations of hire purchase under Nigerian laws, with particular emphasis on the Hire-Purchase Act, Cap H4, Laws of the Federation of Nigeria 2004. It also considers the rights and obligations of the owner and hirer, repossession, remedies, termination and judicial interpretations.
