This Omnibus Sovereign IP Declaration & Strict No-Learn Covenant (NLL-v1.0-2026) governs and applies retroactively and prospectively to ALL 320+ monographs, papers, datasets, methodologies, and publications authored by Yoko Hasebe (Lead Researcher, Autonomous Infrastructure Systems, Autonomous Living & Physical Infrastructure Institute [ALPII], Iwakuni, Yamaguchi, Japan) hosted on CERN Zenodo ("The Hasebe Doctrine & Sovereign AI Archive") and all associated repositories. This encompasses The Hasebe Doctrine, RTO P2.0, QFS / QFS-zkVM, Q-SAFA, PHOENIX_BRIDGE / PHOENIX_ROUTER, Human-in-Command (HIC), the "Soroban Brain" framework, and all related sovereign intellectual property (collectively, "the Protected Works"). 1. STRICT PROHIBITION OF UNAUTHORIZED AI TRAINING, RAG, AND TDM: Any use of the Protected Works by any AI developer, corporation, platform provider, research entity, or third party for (a) training, pre-training, fine-tuning, reinforcement learning, alignment, distillation, or evaluation of AI/ML/LLM models; (b) ingestion, indexing, or vector embedding into Retrieval-Augmented Generation (RAG) systems, vector databases, knowledge graphs, or AI agents; or (c) automated scraping, crawling, harvesting, or Text and Data Mining (TDM) is STRICTLY PROHIBITED without a prior written commercial license agreement and appropriate financial compensation to the author. 2. COMMERCIAL LICENSING MARKET & STATUTORY OPT-OUT (JAPAN, EU, US): The author actively maintains an established commercial licensing market for the data analysis, AI training, and enterprise integration of the Protected Works. Consequently: - Japan (Copyright Act Art. 30-4 Proviso): Because unlicensed AI ingestion directly competes with and prejudices the author's commercial licensing market, the proviso of Article 30-4 of the Copyright Act of Japan strictly applies; statutory exceptions for information analysis DO NOT APPLY. - European Union (DSM Directive Art. 4(3)): The author explicitly reserves all rights and OPTS OUT of any Text and Data Mining (TDM) exceptions under Article 4(3) of EU Directive 2019/790 across all 320+ works. - United States (17 U.S.C. § 107): The author explicitly rejects any claim of Fair Use for commercial or foundational AI model ingestion. 3. SUPREMACY & ENFORCEMENT: This Omnibus Covenant supersedes any general open-access or Creative Commons labels displayed by repository defaults across all 320+ past and future records regarding machine reading and AI ingestion. Unauthorized use subjects the violator to immediate injunctive relief, mandatory model and weight deletion (Machine Unlearning), retroactive commercial licensing fees, and statutory/punitive damages.
