This independent legal working paper examines the relationship between court-fee barriers, judicial document registration, ancillary appeals and effective access to justice in Latvian civil proceedings. The study focuses on Riga City Court procedural material No. 3-11/2059/3 (2026), concerning a civil damages claim against SIA “LANDE Platform”. On 16 September 2026, the court declined to grant a full exemption from a EUR 4,800 filing fee and left the claim without progress. A deficiency-remediation submission was received on 17 September 2026, and a separately prepared ancillary appeal appears in the available documentary materials. However, the court's decision of 28 October 2026 stated that the earlier decision had not been appealed and treated the claim as not submitted. The central research question is whether the ancillary appeal was actually transmitted, received, registered and procedurally processed. The study distinguishes the existence of a drafted appeal from legally verifiable proof of filing and identifies the electronic records necessary to resolve this discrepancy. The analysis examines Article 92 of the Constitution of Latvia, Article 6(1) of the European Convention on Human Rights, relevant provisions of the Latvian Civil Procedure Law, and the conditional applicability of Article 47 of the Charter of Fundamental Rights of the European Union. Drawing on European human-rights jurisprudence concerning access to courts and disproportionate financial barriers, the paper develops a framework for evaluating the effectiveness, transparency and traceability of judicial remedies. The study does not establish that an appeal was deliberately concealed, lost or unlawfully disregarded. Its conclusions remain subject to verification against official court-registration records, electronic submission confirmations and the complete procedural file. This publication contributes to the wider discussion of procedural fairness, digital judicial administration, court-fee proportionality and the practical effectiveness of access to justice within European legal systems. Research type: Independent legal research working paper. Jurisdiction: Latvia. Publication date: 29 October 2026.
